REPACKIT USA TERMS AND CONDITIONS OF SALE

Repackit USA (REPACKIT USA, “we”, “us”) and Customer ("Customer", “you”), in consideration of the mutual covenants, agreements and provisions set forth herein and hereon, hereby agree that the purchase of REPACKIT USA products ("Products")shall be subject to and in accordance with the following terms and conditions:

1. ORDERS FOR PRODUCTS

 All Customer orders for Products shall be subject to these terms and conditions and, if applicable, an authorized quotation issued by REPACKIT USA. The parties hereby agree that these terms and conditions shall govern and control the relationship between REPACKIT USA and the Customer and that the terms and conditions contained herein shall supersede the terms and conditions contained in a Customer-issued order. REPACKIT USA reserves the right to refuse orders in its sole discretion, or to accept such orders on a separate contract form.

2. PAYMENT DUE

Payment must be paid in advance or at the time of REPACKIT USA release of the Products to shipper or carrier. Customer will be responsible for all necessary transportation costs, insurance charges, customs duties and documents, importation taxes and fees, sales taxes, tariffs and loss or damage settlements unless it is stated otherwise on our website.

3. TERMS AND DELIVERY

Unless instructed otherwise by Customer, REPACKIT USA will select the carrier and purchase shipping insurance on Customer’s behalf. REPACKIT USA will add all shipping, handling and insurance charges to Customer’s invoice. Delivery of the Products shall be CIP (Carriage and Insurance Paid) or FCA (Free Carrier) (Incoterms 2000) at REPACKIT USA facility. REPACKIT USA may make partial and advance deliveries. If you cause a delay in delivery you will be invoiced for additional costs incurred, including costs of storage and insurance.

4. ASSISTANCE

If there is a problem with a Product you purchased from REPACKIT USA, you should refer to the user's reference manual for assistance. Except as is otherwise stated herein, if you are unable to resolve a problem with a Product, you may contact REPACKIT USA, at no additional charge for telephone assistance between the hours of 8 am to 5 pm MST, Monday through Friday.

REPAIR, REPLACEMENT, OR REFUND at REPACKIT USA option under the terms of the warranty, and such repair, replacement, or refund shall satisfy REPACKIT USA entire obligation to you for a defective Product and liability for all damage, injury or death caused thereby, whether in contract, tort, negligence, strict liability or otherwise. By placing an order to REPACKIT USA, Customer declares to have read and understood the published REPACKIT USA Warranty Statement, its details and limitations.

6. RETURN POLICIES:

Product Return Policy If you are dissatisfied with your purchase of one or more of our products, you may return only NEW-NON USED products to REPACKIT USA within 30 days. All products must be returned in the original condition with all contents manuals & or accessories. REPACKIT USA will provide you with a full refund, minus the shipping costs and a restocking fee of up to 20% of the price of the item(s) that are properly returned (depending on the condition of the package & or items). In order to receive a refund, your items must be returned to REPACKIT USA undamaged, freight prepaid, insured, and postmarked within 30 days of receipt. NO REFUND OR CREDIT IS AVAILABLE AFTER THE 30-DAYS.

If you have an item you that you have used but believe it to be defective, please refer to our product warranty policy for legal details and contact us to have your product inspected, repaired or replaced according to Repackit USA warranty procedures.

The 30-day Product Refund Policy applies only to Products purchased directly from REPACKIT USA.

 7. EXCLUSIONS AND LIMITATIONS

This Limited Warranty applies only to the Warranted Products.  This Limited Warranty does not apply to any other products, whether or not packaged or sold with the Warranted Products.

This Limited Warranty can be redeemed only by the original purchaser at the original location where Repackit USA shipped the Warranted Product. If you wish to transfer this Limited Warranty, please contact Repackit USA for more information.

This Limited Warranty does not apply to the following:

Normal wear or deterioration; improper installation or maintenance including but not limited to failure to follow any preventative maintenance schedule; Damage caused by accident, abuse, misuse, misapplication, or failure to follow usage directions;

Warranted Products that have been used with non-Repackit USA products;

Damage caused by service performed by anyone other than Repackit USA or an Repackit USA-certified service technician;

A Warranted Product that has been modified without the written permission of Repackit USA;

If any Repackit USA serial number, date stamp or other marking has been removed or defaced;

Any item concerning the Warranted Product’s appearance that is not due to a defect in material or workmanship.

TO THE MAXIMUM EXTENT PERMITTED BY LAW,THIS LIMITEDWARRANTYAND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVEAND IN LIEUOFALL OTHER WARRANTIES, REMEDIES ANDCONDITIONS, WHETHERORALOR WRITTEN,EXPRESS OR IMPLIED. REPACKIT USA SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES,INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.IFREPACKIT USA CANNOTLAWFULLYDISCLAIM OR EXCLUDE IMPLIEDWARRANTIES UNDER APPLICABLE LAW, THENTO THE EXTENT POSSIBLEANY CLAIMS UNDER SUCH IMPLIEDWARRANTIES SHALL EXPIRE ON EXPIRATIONOF THE WARRANTY PERIOD. No Repackit USA reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.

IN NO EVENT SHALLREPACKIT USA BE LIABLE,WHETHERIN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, FOR DAMAGES IN EXCESSOF THE PURCHASE PRICEOFTHE WARRANTED PRODUCT WITH RESPECT TO WHICH SUCH DAMAGES AREASSERTED, PLUS ANY FREIGHT CHARGES ACTUALLY PAID ATTRIBUTABLE TO SUCH WARRANTED PRODUCT,OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL , PUNITIVEOR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDINGLOSS OF PROFITS, LOSS OF USE, INTERRUPTION OF BUSINESS, OR ANYCOSTSOF RECOVERING ORREPRODUCINGANY PROGRAM ORDATASTORED IN AN OPTICAL DISC, ARISING OUT OF OR INCONNECTION WITH THEUSEOF OR INABILITY TO USE THE WARRANTED PRODUCTOR REPACKIT USA’S PERFORMANCE OF ITS OBLIGATIONS HEREUNDER, TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW.

This Limited Warranty gives you specific legal rights and you may also have other rights that vary from jurisdiction to jurisdiction.

OBTAINING WARRANTY SERVICE

If you have a problem with one of the Warranted Products, DO NOT SHIP THE PRODUCTS DIRECTLY TO REPACKIT USA. Instead, please contact our Technical Support personnel for a Return Materials Authorization (RMA) number and instructions.

For all warranty service, the Warranted Product must be returned to Repackit USA or a Repackit USA designated repair center with all transportation and insurance charges prepaid all the way to REPACKIT USA warehouse. RMA number, dated proof of purchase and whom it was purchased from, as well as an explanation of the problem, must accompany the Warranted Product. You are responsible for any shipping costs, import/export duties, taxes and other such fees.

If Repackit USA determines that some of the necessary repairs are not covered under this Limited Warranty, you may request an estimate and the opportunity to confirm whether you agree to pay for these repairs. If you decline, Repackit USA obligations for that machine or product under this Limited Warranty end.

8. RETURN MATERIALS AUTHORIZATION (RMA) REQUEST

For PURCHASES made through a Repackit USA Reseller please read the following.

-       RMA Options

You may only select one type of RMA (refund, replacement or repair) per RMA request.

  • Refund RMA

An RMA refund is a request for a refund of the purchase price (view warranty information). If the product you wish to return is defective, you may only request an RMA repair. If you are unable to select Refund as your RMA type, it is possible that the product you wish to return is either ineligible for refund or is beyond the allowed timeframe for a refund.

All RMA refunds are subject to a 20% restocking fee.

  • Replacement RMA

If you receive a defective item and would like to exchange it for a replacement of the same make and model, select RMA Replacement. Most of our products, unless otherwise specified (view warranty information), can be returned within 30 days of the original invoice date. Please note that all packing materials, manuals, diskettes, CDs, digital media, blank warranty cards and other accessories and/or documentation must be included in the original packaging, as provided, for your return to be processed.

  • Repair RMA Request

If you purchased an item and it is now 30 days past the invoice point. You can request that we repair the unit if you believe it to be covered by our warranty policy or you can request a repair to be performed or a quotation to be given for work.

Warranty

If you believe your product is covered by our warranty policy then you may request a Repair RMA request. The return authorization number & details will inform us that the product is expected to arrive in the condition as you describe it and let the technician know details of problem you are describing. Please note that although a Warranty RMA number may issued to you, this does not mean that the product is automatically qualified as covered under our warranty policy.

Should a technician discover that the damage or defect (partial or whole) is not covered, you will be contacted with a quotation for any additional charges, unless otherwise stated by you.

Warranty claims made after 30 days of the purchase date is required $40.00 shipping and handling fee.

Non-Warranty

If your product does not carry a warranty or the warranty has expired, you can request an RMA for us to receive the product, inspect it and provide a quotation for work to be performed. If you are unsure of the warranty status, please check the unsure selection. Proper selection of the warranty status will speed up the process.

Please note that all packing materials, manuals, diskettes, CDs, digital media, blank warranty cards and other accessories and/or documentation must be included in the original packaging, as provided, for your return to be processed.

Return Instructions:

You may only select one RMA type (refund, replacement or repair) per RMA number. Therefore if you have one product you want to return for repair and one you want to return for refund from the same order, it will be necessary to request two separate RMA numbers.

All returned products must have a Return Merchandise Authorization (RMA) number or your return will not be processed.

In order for Repackit USA to effectively process your RMA request it is essential to include everything the product(s) shipped with. This may include but is not limited to: manuals, software, Polish Pads, cables and the original retail packaging.

You must clearly write your RMA number on the outside of the shipping box. If you send multiple RMAs in one box you must write each RMA number on the outside of the package. Please also be certain to carefully mark and separate the items in the box so our Returns Department can accurately process your RMAs.

Monitors, computers, motors and some other products contained within Repackit USA machines are serviced exclusively by the individual product manufacturer. We will facilitate this process, by submitting the product to the appropriate manufacturer, however we must adhere to and abide by their warranty / repair policy times and procedures. In certain circumstances Repackit USA may have to wait for a product to be repaired and returned to our facility for testing, calibration and installation.

Online RMA Terms:

Repackit USA’s online RMA application does not allow non-refundable/non-exchangeable merchandise or products beyond the applicable warranty coverage to be selected.

Physical damage and/or physical modifications will void the warranty of any Repackit USA product. This includes but is not limited to physically damaged CPUs, which are burnt, chipped, cracked or have bent and/or missing pins. All physically damaged merchandise will be returned to the customer and the warranty will be null and void.

RMAs for refund/repair will be processed upon Repackit USA’s receipt of the product(s). Replacement merchandise will not be sent out until we receive your RMA'd item(s) and process the return. Refunds/credits will not be issued until Repackit USA has received your RMA and processed it accordingly.

Please allow 3-5 business days for processing once we receive your return. You will be kept up-to-date as to the RMA's status via email.

If you selected an APO/FPO address as your return shipping destination, your replacement will ship via the USPS.

Standard Warranty

Products sold by Repackit USA are supported by our Standard Warranty unless otherwise indicated. Merchandise under our Standard Warranty may be returned within 30 days of the original invoice date for a refund or returned for replacement within one year of the original invoice date. All returns require an RMA (Return Merchandise Authorization) number.

Physical Damage Policy

Physical damage includes but is not limited to improper handling and/or any other type of damage sustained by irregular usage on ANY part, machine or component.

Physical damage to any product purchased at Repackit USA or its Resellers or distributors will effectively void our standard and/or Extended Warranty coverage.

Supplies (consumables)

Defective Product(s) must be sent in and be evaluated before replacement can be granted. Normal range of life of usage or mistuning of a machine will not receive. Only product that has is determined as defective will be replaced with the same or equal quantity of product.

Replacement period: No items are eligible for return or replacement after 30 days from original invoice date.

Additional Product Warranty Terms

Declaring a Product is defective and requesting a Refund does not automatically waive the restocking fee.

All defective and DOA Products will be replaced upon return.

Repackit USA will not cross-ship replacement Products.

Your return must be postmarked within 7 days of the original invoice date to qualify for a refund.

Physical damage of any kind will void any applicable Standard or Extended warranty coverage.
